Because of the very specific nature of the Web site information we need, it may be easiest for your Webmaster or System administrator to fill out the form. Pursuant to binding agreement, between Global Internet Solutions also known as GIS, 3516 Barklay Dr NE, Olympia, WA 98516 and the undersigned (herein the "Subscriber"). Subscriber shall make payment in full within thirty (30) days after receipt of initial invoice, and thereafter shall continue to pay monthly according to the payment schedule above until this service agreement is canceled in writing. The Subscriber hereby agrees to provide the necessary information to permit Global Internet Solutions to fulfill this service agreement.
Subscriber does hereby contract with Global Internet Solutions MaxStats to provide Subscriber those services set forth. Subscriber, its agents and affiliates agree to fully comply with and adhere to the installation procedures provided by Global Internet Solutions. Subscriber shall not assign its rights hereunder. Subscriber hereby warrants and represents that Subscriber has the proper authority to make this agreement.
Subscriber agrees and acknowledges that Global Internet Solutions owns all rights, title and interest, including, but not limited to, copyright, patent, trade secrets, and all other intellectual property rights, in and to the MaxStats program. Subscriber further acknowledges to Global Internet Solutions that any information provided concerning the MaxStats program shall be private and confidential.
Subscriber agrees that Global Internet Solutions shall not be responsible for any harm or damages that may be suffered due to failure, delays, system malfunctions or any other damages related to the MaxStats program. Global Internet Solutions shall NOT be liable for any damages, including, but not limited to consequential, actual, special, exemplary, incidental or indirect damages, arising out of or in connection with this agreement, regardless of any failure of the essential purpose of this agreement.
Subscriber acknowledges and agrees that Global Internet Solutions may collect, distribute and use all the data it acquires, archives, processes or compiles for, from or on behalf of Subscriber provided, however, that any use of the data will not contain, directly or indirectly, any reference to the identity of Subscriber or its customers. Global Internet Solutions agrees that it will not transfer, provide or make available to a third party any of the information gathered or related to the MaxStats program.
Subscriber agrees that Global Internet Solutions may disclose publicly that Subscriber is a customer using MaxStats. Global Internet Solutions shall be permitted to use Subscriber's name in written advertisements and in all of Global Internet Solutions' marketing and sales efforts.
Subscriber agrees to display the MaxStats logo prominently at Subscriber's Web site and on any and all pages that refer to statistics reported by MaxStats/Global Internet Solutions.
